Scope and Overview: MedUS, Inc., and its subsidiaries, including the entity that administers the Site where you are accessing this Privacy Policy (collectively, “we”, “us”, “our” and “MedUS”), value your privacy and aim to make your experience with MedUS as satisfying and safe as possible. “Site” being the website associated with MedUS, Inc., or its subsidiaries and includes the website you accessed this Policy through. As used in this Privacy Policy, the terms “you”, “your”, or “User” shall refer to any individual or entity who accepts this Policy. We have developed this Privacy Policy (the “Policy”) to explain how we may collect, retain, process, share and transfer your Personal Data when you use our Services. The term “Services” refers to any products, services, content, features, technologies or functions, and all related websites, applications and services offered to you by MedUS in connection with your use of the Site or another agreement with us. This Policy applies to your Personal Data when you use the Site and/or our Services and does not apply to online websites or services that we do not own or control, including information you provide to a third-party service provider related to or whose services are incorporated into our Services.

This Policy is designed to help you obtain information about our privacy practices and to help you understand your privacy choices when you use our Services. We may, in our sole and absolute discretion, change or modify this Policy and any policies or agreements which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon posting to the Site. No revision or update will apply to a dispute which we had actual notice on the date we post the changes or modifications. We will notify you of such changes or modifications by posting them on the Site, and your use of the Site or the Services after such changes or modifications have been posted (as indicated by a “Last Revised” date) shall constitute your acceptance of the Policy as last revised. Personal Data: We do not sell your Personal Date to third parties. We may, however, employ third parties to facilitate our Services, to provide services on your behalf, to perform Site-related services (i.e., without limitation, maintenance services, database management, web analytics and improvements of the Site’s features), to assist us in analyzing how our Site and Services are used, or to market to you. You will have an opportunity to opt-in to receive text messages. We may use both text messages if you opt-in and/or email to share information about any and all potential employment opportunities with you. We will not disclose your name, telephone number, or other personal information to any other companies or individuals, except as described in this Policy, unless you authorize us to do so or except where needed to deliver a service to you. If you do not want to receive follow-up marketing from us on potential employment opportunities, you can opt out at any time. To opt out of receiving text messages, you simply need to respond with the word “Stop.” Except for follow-up marketing, we only share your Personal Data to operate our business and for the purposes described in this Policy.

Other companies sometimes provide certain services to us or on our behalf. Unless we tell you differently or as described elsewhere in this Policy, our service providers are not permitted to use your Personal Data except to assist us.

This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. Your Rights: You have the right to request access to the Personal Data that we have collected about you for the purposes of reviewing, modifying, or requesting deletion of such data. You may have the right to request a copy of the Personal Data we have collected about you and to have any inaccuracies corrected. You may also request that we cease processing your Personal Data. However, this decision will be left to our sole and absolute discretion. Notwithstanding this section, note that we may need to retain certain Personal Data where required or permitted under applicable law. In addition, you have the right to ask us not to share or sell your Personal Data or use it for purposes of targeted advertising or profiling.

Limitation on Damages: To the fullest extent allowable by law, in no event shall MedUS (or any of its officers, directors, shareholders, employees, subsidiaries, affiliates, agents or advertisers), be liable for non-direct damages whatsoever (including, without limitation, incidental or consequential damages, lost profits, or damages resulting from lost data or lost employment opportunity) resulting from or arising under or in connection with the services or the use or access to the Site and Services of MedUS, whether based on warranty, contract, tort or any other legal theory, and whether or not MedUS is advised of the possibility of such damages. In no event shall MedUS (or its officers, directors, shareholders, employees, subsidiaries, affiliates, agents or advertisers) be liable for any direct damages in excess of the aggregate amount of $100.00.

Warranty Disclaimers: This Site and the Services provided are provided on an “as is” basis without any warranties of any kind, express or implied. To the fullest extent allowable by law, all warranties are disclaimed, including but not limited to, the warranties of merchantability and fitness for a particular purpose.

Release: To the fullest extent allowable by law, by submitting your application, you hereby release MedUS from any and all claims, demands, and damages (actual and consequential and direct or indirect) of every kind and nature, known and unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected to the submission of your application, the information you provided therein or your use of our Site and Services.

Indemnity: You shall indemnify and hold harmless MedUS and its subsidiaries, affiliates, officers, directors, employees and agents from and against any third party claims, actions or demands (including, without limitation, costs, damages and reasonable legal and accounting fees) alleging or resulting from or in connection with the information you provided in your application, documents you provided, use of MedUS services, or breach of this Policy, will entitle MedUS to equitable relief and recovery of its attorneys’ fees and other legal costs.

Applicable Law and Venue: This Policy shall be construed and enforceable according to the laws of the State in which MedUS is headquartered, and you hereby submit to the exclusive jurisdiction of those courts. The sole and exclusive venue for disputes arising from this agreement or services related thereto shall be in the county in which MedUS is headquartered.
